IVA not a option due to unstable employment history.

Debt: £21,325 Was paying: £450/month
Now paying: £300/month
This client lost his job and was out of work for several months. He began to live on credit and the balance grew to £21,325. The client started a new job month ago, but must serve a 3 month probation period.

He has a value of debt that makes him eligible for an IVA. However, the fact that he had just started a new job and has recently had a period without work means this option is not currently available to him.

Creditors need to be confident that payments into the IVA will be made at the agreed rate each and every month for 5 years. A Debt Management programme is more flexible in this respect and suits this clients current situation.

1. What if my creditors continue to pursue me for payments ?

In the short term, while your debt repayment plan is being setup, your creditors may continue to take action to recover your debts. Do not ignore them. Deal with calls politely, informing creditors that you have appointed ourselves to act on your behalf. Please forward any letters to us to deal with on your behalf. Generally speaking, creditors are normally synthetic to those in difficulties and doing they up most to maintain reduced payments by using a debt management company.

2. One of my creditors say they will take me to court if I use a debt management company?

Creditor can't legally refuse payments via a debt management company and then take you to court for non-payment. In reality, your bank and other creditors will soon turn their attention to chasing those currently paying nothing, rather than people clearly with difficulties, but make every effort to repay what they can afford.

3. Can I do debt management if I already have CCJ's against these debts ?
