His assets are more than his debts, but he can't pay 11 creditors from a monthly income of £1,060. An IVA is not possible as his creditors would never agreed to forgive any debt when he could repay them in full by selling his property. The client does not want to remortage as he has recently become self employed and does not want to risk his home if that does not go to plan. 1. Why would anyone with debts over £15,000 do debt management when they could write off debt with an IVA?
Not only do you need more substancial debt for an IVA, you have to be techncially insolvent, meaning your assets must be worth less than your debts. If you have equity in property, that is taken into consideration by your creditors when considering your IVA propsal. Normally you would be expect to remortgage at some point of the IVA period to raise funds to pay into the IVA.2. Am i getting Unbiased advice ?
