An administration order allows you to make one affordable payment to the court, covering all your debts.
The court divides your monthly payment between your creditors, pro-rata according to the size of each debt.
The court manages your debts and deal directly with your creditors.
While the order is in force, none of the creditors named on the order can enforce payment of the debt or try to bankrupt you without asking the court.
You will not need to pay a fee when you make an administration order application. However, the court will deduct 10% for its costs from each of the payments you make. This means you pay back 111.1% of the original debt.
Token Payments
If you are on a low income and/or benefits the court may consider token payments of as low as £5 per month,.
Do I Qualify for an Administration Order?
- You must have as least two debts.
- At lease one debt must be subject to a High or County Court judgment.
- Your debts as stated on the list of creditors must not be more than £5,000.
If you satisfy these requirements, you may qualify for an administration order. If you do not qualify or you think you may qualify but need further advice, contact us for Free Advice specific to your circumstances.
Composition Orders
A Composition Order is a variation to a Administration Order where, instead of being ordered to repay the full amount of your debts, you are be ordered to only part of the debt, with the rest being written off.
A Composition Order may be granted if it seems unlikely that you will be able to pay off your debts within a reasonable time, and is generally more appropriate for people who are on a low income, such as the sick, disabled, elderly, unemployed and lone parents.
